The Legal Debate on Basic Education Financing in the Brazilian Constituent Assembly (1987-1988)

ABSTRACT
The article analyzes the legal debate surrounding the financing of basic education in the National Constituent Assembly of Brazil (1987-1988), focusing on the main dichotomy that guided the discussions, that is, the opposition between public and private education. The article addresses how the main entities organized themselves into three fronts of action: publicists, privatists, and confessionals, fighting battles for the direction of public spending. In fact, contrary to popular participation in the initial phase, the alliance between privatists and confessionals imposed, in the final stage, a setback to the publicists through procedural maneuvers, which was decisive for the outcome of the constitutional text.

Résumé
L'article analyse le débat juridique autour du financement de l'éducation de base à l'Assemblée nationale constituante du Brésil (1987-1988), en se concentrant sur la dichotomie principale qui a guidé les discussions, à savoir l'opposition entre l'éducation publique et l'éducation privée. L'article examine comment les principales entités se sont organisées en trois fronts d'action : publicistes, privatistes et confessionnels, se battant pour l'orientation des dépenses publiques. En effet, contrairement à la participation populaire dans la phase initiale, l'alliance entre les privatistes et les confessionnels a imposé, dans la phase finale, un revers aux publicistes par des manœuvres procédurales, ce qui a été décisif pour le résultat du texte constitutionnel.

Resumen
El artículo analiza el debate jurídico en torno al financiamiento de la educación básica en la Asamblea Nacional Constituyente de Brasil (1987-1988), centrándose en la principal dicotomía que guió las discusiones, es decir, la oposición entre la educación pública y la educación privada. El artículo aborda cómo las principales entidades se organizaron en tres frentes de acción: publicistas, privatistas y confesionales, librando batallas por el rumbo del presupuesto público. En efecto, contrariamente a la participación popular en la fase inicial, la alianza entre privatistas y confesionales impuso, en la etapa final, un revés a los publicistas a través de maniobras reglamentarias, lo que fue decisivo para el resultado del texto constitucional.
